Either driver involved in the car crash can be sued for wrongful death, depending on the situation. For the lawsuit to be successful, the plaintiff has to prove that negligent driving caused the accident.

For example, if the driver was texting while driving and that resulted in a car crash, the plaintiff can sue them for wrongful death (even if they were also injured and the deceased party was in their vehicle).
